On January 4 the president of Belarus signed decree #5 to approve laws development plan for 2006. As BelTA was informed in the presidential press service, the document was drawn up taking into account more than 140 corresponding proposals put forward by the state bodies concerned.
The plan aims to fill up the gaps in the legal activities in different spheres of life of the state and to bring laws in line with the president’s decisions, international agreements of Belarus and to coordinate them.
In line with the plan in 2006 some 15 laws (integrated and new wordings) will be drafted.
Some draft laws are included in the plan bearing in mind analysis of public relations development. It proves that at present it becomes urgent to settle issues of development and introduction of a new centralized registration system – a population register, forming the state material reserve, mortgage lending and rapidly developing informatization sphere.
The plan for 2006 was drawn up taking into consideration the president’s instructions. In this conjunction it envisages drafting of laws “On professional retirement insurance”, “On labor protection”, “On population register”, “On introducing amendments and addenda into the law of the Republic of Belarus “On state registration of improvable property, the rights for it and real estate bargains”.
Moreover, in line with the state village revival program for 2005-2010 the plan envisages drafting of the law “On introducing amendments and addenda into the law of the Republic of Belarus “On administrative-territorial division and the order of settlement issues of the administrative-territorial organization” (in particular the notion “agro-town” and its status).
According to the plan, the Belarusian president will bring in 7 laws to the parliament in 2006.
This year specialists will continue the practice initiated in 2005 by the president to plan the process of development of concepts of drafts for most complex and essential laws. In this respect the decree has approved the plan of development of concepts for laws in 2006. For instance, present day legal and socio-economic conditions have created a necessity to develop the concept of a draft law “On the basic administrative procedures”. The use of rights and pursuance of law-secured interests by natural persons and legal entities in most cases is connected with the necessity to apply to the local executive and administrative bodies for references, individual legal enactments and other administrative actions. At the same time Belarus lacks the appropriate legislative regulation of public relations connected with administrative procedures.
The draft law “On the basics of administrative procedures” envisages setting the single “one-stop shop” principle of work with natural persons and legal entities and a principle of “cooperation between the state bodies (organizations)”.
The validation of the decree will allow for further improvements in the national legislation, meeting the instruction of the president to eliminate the red tape and promote comfortable and convenient living environment for people in the country.
